Mediation

Mediation, a structured process for resolving disagreements outside the courtroom, has three styles – facilitative, evaluative, and transformative. While transformative mediation is seldom used in Arizona, thousands of facilitative and evaluative cases are mediated annually. Facilitative mediation is used for family law and domestic relations issues, and evaluative mediation is the style used in addressing civil court cases.

Typically mediation is a voluntary process; however, some business contracts as well as brokerage and investment agreements require parties to mediate their dispute before heading for the courtroom.

At Rose and Huey, PLLC, our comprehensive legal services in multiple practice areas include mediation as a highly effective method of alternative dispute resolution. Mediation allows couples involved in divorce, child custody, modification and enforcement of court orders and other family law matters to arrive at solutions in private, with less anxiety and more economically than in court. Our attorneys also make good use of mediation in assisting clients to settle differences in a broad range of business conflicts related to employment, contracts, dissolving partnerships, real estate transactions and disputes between buyers, sellers, brokers and builders, personal injury and medical malpractice, to name a few instances.

Choosing mediation affords our clients numerous benefits such as:

  • Cost effective means for settling a dispute
  • Arriving at a solution in private
  • Maintaining confidentiality
  • Protection from media exposure
  • Resolving a conflict faster than if taken to court
  • Avoiding negative effects lawsuits have on family or business relationships

Our firm’s experience has demonstrated that encouraging parents, couples, business partners and associates to mediate differences, yields positive results more often than not. However, in the face of an uncompromising party on the other side of the mediation table, our clients can rely on our skills as trial lawyers to protect their best interests and meet their objectives in a court of law. Rose and Huey’s trial lawyers represent clients in all Arizona State Courts, the U.S. District Court, District of Arizona, the U.S. Court of Appeals, Ninth Circuit and the U.S. Supreme Court.

When you are mired in a contentious individual, family or business controversy, call the Phoenix law firm of Rose and Huey, PLLC at (602) 340-8400 to explore how mediation can help you to arrive at a mutually beneficial and creative solution for your problem.
